All it takes is a Cease and Desist letter, sent via certified mail.  
When you get one of those, you can rest assured you are under the 
magnifying glass.  And you can also rest assured that Apple has 
considerably more resources that you do.

It's how monopolies keep control.  And Apple is just as much of a 
monopoly as Microsoft, just with a particular hardware platform instead 
of software.
