With all due respect to MBurke's thoughtful comments, I do not give free legal advice, nor do I believe this is the proper forum in which to do so.  I believe such a topic is certainly not consistent with this list.  

Anyone who is serious about such issue -- instead of merely pontificating -- should consult a lawyer who specializes in intellectual property matters if you have a specific business need.  If you get such advice for free, chances are that is exactly what it is worth.
