I would say you are not stealing, in fact you bought the CD, it got 
damaged but it's a simple scratch, enough to destroy the product 
(flawed design, or innately flawed?)

If you ask me it wouldn't be stealing, in fact it would be a 
replacement and an inferior one at best.
