FCP3 Install on system w/o OS9?

you have an upgrade FCP3 install disk; you can call Apple and request they
send you a replacement OSX FCP3 install disk that does not require an OS9
installation. In the past they have required you show proof of purchase of a
non-OS9 computer to waive the fee. ($20)
If the AppleCare person does not know what you are talking about (they all
should since they've been dealing with this for 6 months) ask for the
MultiMedia specialist.
