You probably misread the OP. /private/var/vm is a directory. 
/private/var/vm/swapfile* are not directories.

As to CCC, by default it removes a number of items, including 
/private/var/vm/swapfile*. If CCC did copy the swapfiles, then you must 
have modified its advanced prefs (see "Advanced Features" in CCC Help).
