backing up home folder fails

I'm trying to backup my Home folder to dvd-r using Toast Titanium.
Each time the backup has failed with first this error message:
"The file "com.apple.netinfoManager.plist" could not be accessed. (Data 
fork, -5000)

I click 'OK" then get this message:
"Couldn't complete the last command because don't have the required 
access permission.
Result code = -5000"

First, I thought OS X didn't use data forks anymore.
Second, how can I not have permissions to my own home folder> (I
regularly Repair Permissions).

I hate to throw anymore money away at $2 a dvd.
